Terms & Conditions
1. Force Majeure Event
1.1 "Force Majeure Event" means any act of war, terrorism, fire, flood, cyclone or any other extreme weather conditions, loss of power, mechanical failure, epidemics or pandemics (including COVID-19), public health emergencies, industrial disputes, slow-downs or other strike, riots or civil unrest, acts of government, semi government or other authorities, state and or federal government restrictions, including (but not limited to) restrictions on travel and gatherings, inability to obtain any necessary licence or consent and delays caused by sub-contractors, suppliers or other third parties (including telecommunications carriers), material shortages or other disruption to Red Earth Safaris’ services beyond its control.
1.2 If any Force Majeure Event results in Red Earth Safaris being prevented from, or delayed in, performing any of its obligations to the Customer:
a. then such a delay or prevention of performance shall not be deemed to be a breach of contract or any other obligation placed upon Red Earth Safaris under these terms and conditions;
b. no loss or damage shall be claimed by the customer from Red Earth Safaris by reason thereof; and
c. Red Earth Safaris shall use its best endeavours to minimise and reduce any period of suspension occasioned by any Force Majeure Event.
1.3 In the event of a Force Majeure Event, Red Earth Safaris, in its absolute discretion may:
a. cancel or modify any routes within the tour itinerary or objectives set out in the itinerary;
b. substitute different or equivalent routes within the itinerary in place of cancelled or modified routes;
c. postpone, cancel or delay (either in relation to the departure or arrival times or the duration of the itinerary) any aspect of the tour if in the absolute discretion of Red Earth Safaris, it is necessary to do so;
2. Amendments by Red Earth Safaris
2.1 Prices and products, including (but not limited to) accommodation and products as shown on Red Earth Safaris’ website are subject to change. Red Earth Safaris reserves the right to change this information without notice.
2.2 Red Earth Safaris reserves the right to:
a. cancel or modify any routes within the tour itinerary or objectives set out in the itinerary;
b. substitute different or equivalent routes within the itinerary in place of cancelled or modified routes;
c. postpone, cancel or delay (either in relation to the departure or arrival times or the duration of the itinerary) any such aspect of the tour if in the absolute discretion of Red Earth Safaris, it is necessary to do so.
2.3 In the event of any change, modification, cancellation, postponement or delay the Customer acknowledges that the Customer will have no right of refund and no right to claim compensation for any loss and or cost incurred by reason of the change, modification, cancellation, postponement or delay.
3. Amendments by the Customer
3.1 All booking amendment requests must be received in writing from the Customer via email no less than 8 days prior to the departure date.
3.2 Red Earth Safaris may consent to the amendment of a portion of or all of the booking in its absolute discretion.
3.3 The Customer is responsible to ensure any components booked separately are appropriately amended by the Customer.
3.4 The Customer is responsible for any costs incurred in connection with the amendment request, including (but not limited to) new season or other rate increases, third party provider fees, and any rebooking fees payable to Red Earth Safaris.
4. Government Requirements / COVID-19
4.1 If the Customer contracts COVID-19 (or any other pandemic virus or disease) within 21 days of the scheduled departure date, or is instructed to self-isolate by the applicable Government or other authorising body or other persons, the Customer must notify Red Earth Safaris in writing. In such circumstances, the Customer (and any other guest cancelling as part of the booking) will not be able to and will not be granted permission to undertake or participate in the tour. Red Earth Safaris, in its sole discretion, may offer to the Customer a transfer of the tour to an alternative date (subject to availability). Red Earth Safaris reserves the right to request supporting evidence of any contraction of COVID-19 or instruction to self-isolate.
4.2 Where the Customer presents with an elevated temperature or other symptoms of COVID-19 or any other communicable disease or virus (whether you are aware of the condition or not), Red Earth Safaris may in its absolute discretion:
a. refuse the Customer’s participation in the tour;
b. request that the Customer wears a face mask or other protective equipment;
c. request that the Customer undertakes a Rapid Antigen Test; and or
d. request that the Customer concludes the tour at the earliest possible and safest opportunity.
4.3 Where clauses 4.2(a) and (d) apply, the tour will be deemed to have been cancelled by the Customer and Red Earth Safaris’ usual cancellation provisions will apply. All costs incurred by the Customer and or Red Earth Safaris as a consequence will be at the Customer’s own expense. The Customer shall not be entitled to any refund of monies paid by the Customer to Red Earth Safaris under these circumstances.
4.4 Where the Customer presents with an elevated temperature or other symptoms of COVID-19 or any other communicable disease or virus and obtains a negative result to a COVID-19 test, Red Earth Safaris may in its absolute discretion allow the Customer to participate in or re-join the tour.
4.5 Where the Customer is not allowed to participate in or re-join the tour in accordance with clause 4.4 above, the tour will be deemed to have been cancelled by the Customer and Red Earth Safaris’ usual cancellation provisions will apply. All costs incurred by the Customer and or Red Earth Safaris as a consequence will be at the Customer’s own expense. The Customer shall not be entitled to any refund of monies paid by the Customer to Red Earth Safaris under these circumstances.
4.6 The Customer shall comply with all vaccination and or testing requirements and or directions by:
a. the applicable Government (Federal or State);
b. health authority or other authorising body;
c. Red Earth Safaris; or
d. any third-party provider, in relation to COVID-19 (or any other disease or virus), for entry to the location of the tour or to use or participate in the tour.
4.7 The Customer will be required to be fully vaccinated from 31 January 2022. Proof of vaccination will be required prior to participating in any tour including commencing any tour. Where there is any inconsistency between the date specified in this clause for vaccination and any requirement or direction issued by the applicable Government (Federal or State), health authority or other authorising body, any such requirement or direction issued by the applicable Government (Federal or State), health authority or other authorising body will prevail.
4.8 Where the Customer:
a. is unable to meet any requirement (including where the applicable Government, health authority or other authorising body requirement is introduced subsequent to the booking);
b. cancels the booking; or
c. is unable to access the location of the tour, as a result of a requirement referred to in clauses 4.6 and 4.7 above, the Customer shall forfeit all monies paid to Red Earth Safaris.
4.9 Where the Customer does not comply with any requirement referred to in clauses 4.6 and 4.7 above, Red Earth Safaris reserves the right to decline the booking, cancel the booking or refuse the Customer’s participation in the tour at Red Earth Safaris’ absolute discretion and at the Customer’s cost.
4.10 Where the Customer is unable to participate in the tour, or any part thereof, due to COVID-19 (or any other pandemic) border closures and or travel restrictions imposed by the applicable Government or other authorising body, Red Earth Safaris, in its sole discretion, may offer to the Customer:
a. a transfer of the tour, or part thereof, to an alternative date within 12 months (or such longer period as is reasonable and determined by Red Earth Safaris in the circumstances), which transfer option is subject to availability; or
b. a credit, to the value of any monies paid, which credit will be transferable to another person and valid for travel within 12 months from the issue date (or such other longer period as determined by Red Earth Safaris in its absolute discretion), provided that:
c. any additional costs payable on the new tour will be payable by the Customer in full at the time of booking;
d. additional costs may apply for the tour in future seasons; and
e. the credit, or any balance on a partially used credit, is not redeemable for cash.
4.11 The Customer releases and indemnifies Red Earth Safaris from any liability, loss or damage, of any nature, that may occur to the Customer, Red Earth Safaris or any other person (including but not limited to persons departing on the same tour or utilising the same accommodation booked). Such liability, loss or damage may include (but is not limited to) all costs, losses and expenditures arising from the Customer’s use or participation
5. Company Policy - Infectious Diseases
5.1 In accordance with Red Earth Safaris’ duty to provide and maintain a workplace that is free of known hazards, we are adopting this policy to safeguard the health of our customers and visitors, our employees and the community at large from infectious diseases, such as COVID-19 or influenza, that may be reduced by vaccinations.
5.2 From 31st January 2022, all eligible customers, employees and visitors are required to be or have received vaccinations, unless a reasonable exemption is otherwise approved by any relevant authority or Red Earth Safaris. Where a person is not in compliance with this policy, the person will not be granted entry to the tour. In such circumstances:
· for customers, Red Earth Safaris’ refund and or credit policy may apply.
· for employees, they will be placed on unpaid leave until their employment status is determined.
5.3 Red Earth Safaris will not accept a booking for any eligible person that is not fully vaccinated for COVID-19 or does not commit to such requirement. Where a person makes a booking and is then unable to meet the requirement, the customer shall be barred from the tour and Red Earth Safaris’ cancellation policy shall apply.
6. Cancellation Policy
6.1 The customer shall comply with all Government (Federal and State) COVID-19 vaccination or testing requirements for entry into Western Australia or to access the operator's tour. Where the customer does not meet a vaccination or testing requirement:
a. prior to departure from the customer’s home location, the customer will forfeit any and all monies paid; or
b. for entry to the tour, the customer will not be granted entry and will forfeit any and all monies paid.
6.2 Where the customer cancels due to travel restrictions other than vaccination or testing requirements, the customer will be contacted and offered a refund or credit note (to be used at a later time), where such an offer is at the absolute discretion of the operator. The operator reserves the right to withhold some monies to cover administrative expenses and other losses, dependent on when notice of cancellation is given by the customer.
6.3 Cancellation by the Customer;
a. Cancellations within 7 days or failure to board on the day for reasons other than those stated in 6.2 above, will result in 100% full fare forfeiture. Full refunds are given if cancellation received 8+ days prior to departure.
b. If you fail to join or leave the tour for any reason once started, no refund will be paid.
6.4 Cancellation by Red Earth Safaris;
a. Red Earth Safaris reserve the right to cancel a trip at any time prior to departure if it is not viable for the tour to operate in compliance with the planned itinerary. If Red Earth Safaris’ cancels the Customer’s tour, the Customer can transfer amounts paid to an alternate departure date or receive a full refund.
b. Red Earth Safaris are not responsible for any incidental expenses that the Customer may have incurred as a result of the Customer’s booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
c. If for any reason the route is altered and a different itinerary is offered once the tour has started, no refund will be paid.
7. General Terms and Conditions
7.1 Tour departs on Monday from the Tourist Bus Stand, Beaufort Street at 7:30am unless prior arrangements are made at time of booking.
7.2 Tour cost includes transport with an experienced local driver/guide, meals as indicated (please advise of special diets when booking), accommodation as specified (upgrades available, prices on request), national park entry fees, and activities as specified. Red Earth Safaris is fully licensed and accredited. Buses are well-maintained, correctly licensed and insured.
7.3 Tour cost does not include optional activities, personal travel insurance, personal spending money, drinks/snacks/magazines etc.
7.4 Red Earth Safaris cannot predict nature and so cannot guarantee the wildlife, dolphins at Monkey Mia, or the weather. We appreciate your understanding that nature is uncontrollable.
7.5 Red Earth Safaris cannot guarantee availability on Whaleshark Tours. It is advisable to book as early as possible. For 8-day return passengers you must book for the Saturday of your tour in Exmouth.
7.6 Red Earth Safaris are unable to guarantee exact arrival and departure times and are not liable for any failure to make connections with other services. Red Earth Safaris reserves the right to substitute vehicles/services to ensure the operation of the tour.
7.7 Our tours are aimed at the young and the young at heart and they all include hikes of 2+ kilometres over moderate to difficult terrain, often in high temperatures. A moderate level of fitness is required to fully participate in most activities. Tours are not recommended for children under 12 years old.
7.8 Room upgrades are located with the same accommodation provider as the dormitory and are subject to availability. These are budget backpacker/motel style and many will not provide towels. Please make sure you bring one with you. There is no upgrade available at the farm on Thursday and that night is not included in the upgrade package price. A mix of ensuite and shared bathroom facilities are provided. No upgrade available during school holidays.
7.9 Red Earth Safaris recommends all Customers have travel insurance, which should be taken out at the time of booking prior to tour departure. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. If you have travel insurance connected to your credit card or bank account, please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank’s name and credit card details.
